1. Introduction

Thank you for visiting our website www.maisonechelon.com (the “website”, “site”, “we”, “us” or “our”). This website is owned and operated by Echelon Apparels Private Limited, a company incorporated under the applicable laws of India. These terms and conditions regulate the terms by which you use, access and purchase products through the site. We reserve the right to make changes to the website, any policies and these Terms and Conditions at any given time. In continuing your usage of the website, you acknowledge that you have thoroughly read, understood and agree to comply to the terms mentioned below. In case you do not agree with any part of the following conditions, please leave the website. 

 

All content featured on the website, posted or made available through any means by Maison Echelon is property of Echelon Apparels Private Limited including but not limited to visuals, text, audio or video clips. All content is subject to copyright protections and/ or intellectual property rights held by the Company, the website, or its Directors. In using the website you agree to use the services only for personal, non-commercial use with lawful purposes and you recognise that failure to adhere means you may be subject to civil or criminal liability. Without a prior written agreement, you may not copy, reproduce, edit, deep-link into, or distribute any web pages or materials on the site. Any usage of the content or elements comprising the website aside from for personal use leaves you open to repercussions.

 

The name of the brand, ‘Maison Echelon,’ is protected under the Indian Intellectual Property Trademark Act, 1999. It has been trademarked by the Founder/Director of the Company, Echelon Apparels Private Limited, and hence, the brand name exercises all applicable privileges as permitted by the appropriate Acts of IP protection. The website and all services provided by the owner are solely the property of the owner including any and all copyrights, trademarks, trade-secrets, patents or other form of intellectual property. (“Owner Ip”). You agree not to reproduce or distribute the owner IP in any way without written permission from the owner. Any rights that are not expressly granted are reserved. Nothing mentioned in the Terms shall be deemed to give you any rights in or to intellectual property of Maison Echelon. User privacy is of utmost importance to us thus any personal information including emails, addresses etc. are not sold by Echelon Apparels Private Limited to any third parties. However we maintain the right to use and share personal information provided by you for business purposes and/ or for the purposes of investigation. Maison Echelon also assumes no liability for any damages or viruses that may affect your devices when interacting with the site. 

 

Any person accessing the website must be a minimum of 13 years of age or have parental consent in order to use the services. If you are a minor and continue to use the website, it will be deemed that your guardian has read and agreed to the Terms of use specified.

1. Returns and Exchanges

All sales made will be final. We offer no returns or exchanges. When placing your order, please ensure that product size, shipping address and billing address are correct. In case of any errors in your order you may opt for cancellation or reach out to us at house@maisonechelon.com. 

 

2. Shipping/customs

Once your order has been shipped, you will receive a tracking number through email. Charges and timescales for delivery will differ based on the products purchased as well as the delivery address and delivery services based on the country. Each delivery will be to the address specified in your order. Once the products have been delivered to the delivery address specified in your order, all risk including of loss of damage to the products shall lie with you. Maison Echelon holds no liability for any failure to deliver products when specified if the delay or failure is wholly or partly caused by circumstances beyond our control. We reserve the right to define what products can be delivered to a specific destination due to certain customs, legal, regulatory and practical restrictions for international orders. All our products are sold on the basis that the recipient may have to pay for import duty or customs fee required. Any additional taxes, fees or shipping costs are your responsibility. We are also not responsible for packages lost by third party couriers once the package has left our facility and in case of a missing package you can take up the issue with them.

 

3. Personal information

When placing an order you confirm that any and all personal information provided by you is accurate and upto date. The details can be changed by logging into your account. We may ask for personally identifiable information such as Email address, First and Last name, Phone number, Address etc. When creating your account you will be asked to input a password, it is your duty to ensure this information is kept confidential and not shared with any third parties. In case of any issues with the account itself you can contact us at house@maisonechelon.com. Furthermore we reserve the right to delete the account or refuse service to you in case of any breach of the Terms and Conditions. In case you opt to use guest checkout when placing your order, we will have to retain your information to process the order. If an account with the same personal data already exists we won’t be retaining your personal information. 

 

4. Delays and Cancellations

In case your order has been delayed due to any logistical or external circumstances, Maison Echelon will notify you however we are under no liability for any for any delay or failure of delivery. In the event you wish to cancel your order, you must notify us within five business days, unless the product had been pre-ordered. You agree to forfeit rights to cancellation once the order has already been delivered to the specified address. Post receiving the cancelled products, your refund may take up to fourteen days to processed. 

 

5. Subscription

If you choose to add a subscription offer in your transaction, you acknowledge that Maison Echelon has rights to indulge you in communications such as email, sms, and other notifications. If you decide to opt out of these communications, then the subscription offers will be invalid and not applied to your purchases. You may opt for or out of subscription offers by changing your preferences. In subscription offers, Maison Echelon allows the subscribers to place a pre-order for the product which must be done at least seven business days prior to the release of the Design Line. This only stands until the line has been made available to the public through the site or official Instagram page. In order to avail the benefits of pre-order, you will be required to pay an advance of 25% of the price of the product. The subscriber must pay the complete sum of the pre-ordered product within two days of the product release after which Maison Echelon will no longer refund the amount paid. In case of complications with the supply of the product, you will be informed via email and the unavailable products will not be processed. 

 

6. Payment

When checking out you will be asked to enter payment details. By doing so, you confirm that the method of payment is in your name. We will not be storing any payment information however our third party providers may use encrypted secure payment mechanisms to store data. For further information about this, you may see the websites of the individual payment providers. We reserve the right to change product prices at any time as well as the right to choose the currency of payment. 

Furthermore, the price of the product may differ according to the country/location/currency/time/availability as well as the step of the checkout process - the price of the product may vary between the price displayed on the home page and the total price when checking out. 

You are subject to pay all applicable taxes and fees as determined by your location/country/and product. In some cases, the import duties for an international order may be included in the total price of the product. Where that is, the breakdown of the total price will include a section of a ‘Import Duties.’ If paying the import duties during the order, you will not be liable to pay any import costs on delivery for the product you ordered.

7. Order replacement

In case there are any changes to be made in your order you must inform us to prior to their dispatch and this must be done via email. Once the order is placed, you cannot make changes to the name or address.  If you choose to change the order, it is possible that the item is no longer available or that the price of the product has changed.

 

8. Links to third party sites

The site may occasionally feature links to third party websites. These linked sites are not owned by Maison Echelon and we are not responsible for the contents of these linked sites. The inclusion of any links on the site is not synonymous to endorsement by Maison Echelon or any association with their operators.

9. Limitation of liability

In no circumstance shall Maison Echelon be liable to the user for any damages or defects that are caused by actions of a third party. We will also not be liable for any damages arising from, or directly or indirectly related to the use of or inability to use the site or content. To the fullest extent permitted by applicable laws, Maison Echelon hereby excludes and disclaims liability for any loss or damage and you expressly agree that your use of the site is at your own risk.
